If you choose to utilize our Service by reserving a charter or using our website, you automatically accept these Terms. Should you not agree with any part of the terms, access to the Service is not permitted.

2. Service Overview

NeutralObservatory offers an exclusive yacht charter service that includes, but is not limited to:

  • Charter rentals for a day
  • Evening yacht excursions
  • Business outings
  • Functions exclusive to your group
  • Charters over several days

Availability of services is conditional on various factors including weather. We retain the authority to adjust or cease services whenever required.

3. Booking and Reservations

3.1 Booking Process

To secure a charter, you are required to:

  • Confirm you are 18 years old or over
  • Ensure all information provided is both precise and complete
  • Remit the stipulated deposit as indicated in your booking acknowledgment
  • Accept these Terms & Conditions

3.2 Confirmation

Confirmation of your booking takes effect on receipt of the payment and our subsequent written acknowledgment. We retain the discretion to reject providing services to any individual.

3.3 Availability

We offer charters based on the availability of vessels and suitable weather. Every effort will be made to accommodate your chosen dates and times.

4. Payment Terms

4.1 Pricing

All fees are presented in € and are inclusive of taxes unless stated otherwise. The prices can alter without any forewarning.

4.2 Payment Schedule

  • Deposit: Half of the total cost of the charter required at the time of booking
  • Balance: To be paid 48 hours before the departure of the charter
  • Additional charges (if any): To be paid upon completion of the charter

4.3 Payment Methods

Payments can be made using prominent credit cards, bank transfers, and certified cheques. Secure, encrypted systems manage our payment processes.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • Over 72 hours prior to departure: Full refund minus processing charges
  • Between 24 to 72 hours before departure: Half the refund
  • Within 24 hours of departure: No refund is available

5.2 Weather Cancellations

If the captain considers weather conditions to be unsafe, the following options will be offered:

  • The rescheduling of your charter to a later date without additional costs
  • A full refund if rescheduling cannot be accommodated

5.3 Mechanical Issues

Should there be mechanical issues with the vessel assigned to you, we will try to provide an appropriate alternative. A complete refund will be issued if no alternative is available.

6. Safety and Conduct

6.1 Safety Requirements

All guests are required to:

  • Adhere to instructions given by the crew
  • Utilize the provided safety gear as needed
  • Disclose any health conditions that may impact their safety
  • Stay within the areas designated on the vessel

6.2 Prohibited Items

The items listed below are prohibited on board:

  • Containers made of glass
  • Illegal substances
  • Weapons of any sort
  • Excessive amounts of beverages (beyond a reasonable quantity for consumption)
  • Pets (without prior authorization)

6.3 Conduct

Passengers should behave in a considerate manner. We preserve the right to terminate a charter prematurely, with no refund, if passenger conduct endangers safety or disrupts other patrons' experience.

7. Liability and Insurance

7.1 Our Liability

Our accountability is confined to the total invoiced for your charter. We do not accept responsibility for:

  • Personal injury caused by the negligence of the passenger
  • Theft or damage of personal items
  • Indirect or subsequent damages, or penalties
  • Delays resultant from weather or events out of our control

7.2 Insurance Coverage

We uphold inclusive marine insurance which covers our boats and their operational activities. Passengers must arrange their own travel and personal insurance.

7.3 Assumption of Risk

By partaking in our charter services, you accept that maritime activities carry inherent risks and you assume responsibility for your personal safety and welfare.

8. Modifications and Itinerary Changes

We uphold the right to alter itineraries, paths, or schedules in light of weather situations, safety requirements, or operational necessities. Efforts will be made to provide similar alternative experiences whenever possible.

9. Force Majeure

Absence of liability is applicable in instances of delays, cancellations, or changes due to events beyond our control, including but not limited to:

  • Extreme weather conditions
  • Natural disasters
  • Government ordinances
  • Shutdown of ports
  • Vehicular malfunctions

10. Privacy and Data Protection

Your personal data will be handled in line with our Privacy Policy. In using our services, you consent to the collecting and utilization of your information as specified within our Privacy Policy.

11. Intellectual Property

All content on our website, such as text, images, logos, and graphics, is protected by copyright and trademark legislations. The reproduction, distribution, or creation of derivatives is not permitted without our expressed permission.
